Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Ethara service in all of its forms: website (ethara.fr), mobile application (iOS and Android) and browser extension (Chromium-based: Chrome, Edge, Brave, Opera, Arc and compatible browsers).
The service is published by Tugdual Launay, sole trader (French Entreprise Individuelle), hereinafter “the Publisher”. Publication director: Tugdual Launay. Contact: contact@ethara.fr.
1. Purpose
Ethara is an independent service that rates online retailers across seven ethical dimensions (ecology, working conditions, animals, dropshipping, taxation, health, diversity). Its purpose: enabling responsible and informed consumption. Scores are produced from public sources and moderated community reports.
2. Scope
These Terms apply uniformly to the three surfaces of the service:
- Website: information, rankings, access to legal notices and privacy policy.
- Mobile application: analysis, personal history, reports, user accounts.
- Browser extension: contextual analysis of the retailer being visited, available directly from the browser toolbar.
A single user account allows data to be shared between the mobile application and the extension. The website does not require an account.
3. Acceptance
Using any surface of the service means full acceptance of these Terms. If you do not agree, you must not use the service.
Installing the mobile application or the extension is also subject to the terms of the relevant distribution platform (App Store, Google Play, Chrome Web Store, or any other compatible Chromium store). In case of conflict, those platform terms only prevail in respect of distribution.
4. Access to the service
The service is free of charge. Advanced features may, in the future, be offered through an optional Pro subscription; if so, their pricing and cancellation terms will be specified in these Terms before launch.
The Publisher strives to keep the service available but cannot guarantee uninterrupted availability, in particular in case of maintenance, updates, technical incidents or third-party sub-processor failure.
5. User account
Account creation is optional for the website. It is required to use some features of the mobile application and the extension.
Available authentication methods:
- Mobile application: email + password, Google, Apple.
- Browser extension: email + password, Google.
- Website: no authentication required.
Users agree to provide accurate information, keep their credentials confidential, and report any unauthorised use of their account without delay. The Publisher may suspend or delete an account in case of breach of these Terms.
6. Extension permissions
The browser extension requires the following permissions to operate:
- Active tab URL access: to identify the retailer being visited.
- Host permissions: to display the contextual analysis on relevant pages.
- Storage: to store preferences and session locally.
No browsing data is read, collected or transmitted beyond what is strictly required to evaluate the visited retailer. Processing details are set out in the Privacy Policy.
7. Editorial independence
Ethara is independent. No brand can pay to alter its score or remove an analysis. Revenue comes only from donations and any optional subscriptions.
8. Nature of the scores
Scores published by Ethara are editorial assessments based on public sources and moderated reports. They do not constitute professional advice, certification, or any warranty regarding the quality of a product or service. Users remain solely responsible for their consumption decisions.
9. User conduct
It is forbidden to:
- circumvent technical protection measures of the service;
- automatically collect data from the service (scraping, API reverse engineering);
- submit false information via reporting tools;
- impair the operation, security or integrity of the service;
- use the service for unlawful, defamatory or infringing purposes.
10. User-generated content and reports
Editorial reports submitted by users are published upon submission and subject to a posteriori moderation. The Publisher acts as a hosting provider within the meaning of article 6 of French law no. 2004-575 of 21 June 2004 (LCEN), and promptly removes any manifestly unlawful content properly notified under that law.
By submitting a report, the user grants the Publisher a non-exclusive, royalty-free, worldwide licence to use, reproduce and adapt the content for the purposes of the service, for the legal term of protection.
11. Intellectual property
All service content (text, trademarks, logos, interfaces, databases, code) is protected by intellectual property law. Any unauthorised reproduction, representation or reuse is prohibited.
12. Liability
The Publisher cannot be held liable for indirect damages, nor for losses arising from a consumption decision based on published scores. Any liability is limited to the amount paid by the user, if any, over the twelve months preceding the triggering event, within the limits permitted by law applicable to consumers.
13. Personal data
Processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.
14. Changes to the Terms
The Publisher may amend these Terms at any time. Users are notified of substantial changes through the service (in-app notification, banner or email). Continued use after modification constitutes acceptance of the new version.
15. Governing law and jurisdiction
These Terms are governed by French law. Any dispute shall be subject to the jurisdiction of French courts, subject to mandatory rules applicable to consumers allowing them to bring proceedings before the courts of their place of domicile.
In accordance with articles L.611-1 et seq. of the French Consumer Code, consumers may freely refer the dispute to a consumer mediator for an amicable resolution.
